This privacy policy explains how we collect, use, and protect your personal data. We’ll also explain your privacy rights, and how the law protects those rights. That includes data provided by you when visiting our website, contact us, or purchase a service(s) with us. Throughout this policy we will reference the terms ‘we’, ‘us’, ‘our’, or ‘Sail Mortgages’, in doing so we will be talking about Sail Mortgages Ltd. And when using the terms ‘you’ or ‘your’ we’re talking about our customers, as well as individuals who visit our site.

Sail Mortgages Ltd is committed to protecting your privacy and ensuring any personal information we collect is used and stored appropriately, lawfully and securely. To accomplish this, we comply with all the relevant data protection laws including the retained EU law version of the General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

What personal information we collect

Personal information includes your name, address and telephone number and other information that is not otherwise publicly available.   • Transaction Data – details about payments from you and other details related to the products and services you’ve bought from us
  • Technical Data – IP address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform
  • Profile Data – your username and password (if applicable), feedback and survey response
  • Usage Data – information about how you use our website, products and services
  • Marketing and Communications Data – your choices about marketing from us and our business partners, and how you prefer us to contact you
  • Other Data – any other information that could be used to identify you, that we need to help you get a mortgage or buy a home

We collect personal information directly from you. For example, we ask for personal information at the start of our relationship and in subsequent communications in order to check your identity and protect you from fraud. This is a legal requirement and is important to help safeguard you against potential crime.

If you are making a joint application, such as with a spouse, we will also collect some of this information about the person you are applying with. You will need to make sure you have the agreement of this individual before sharing this information with us.

Special Category Information

By acquiring sensitive data, we can provide the most appropriate financial advice to you. This can include data such as lifestyle information or physical and mental health conditions.

The Financial Conduct Authority asks companies, such as Sail Mortgages to give special levels of care to customers they think might be vulnerable. If we think you’re vulnerable, we might record that information to help us give you the right service. This data will also be considered sensitive.

By acquiring sensitive data, we can provide the most appropriate financial advice to you. We will always obtain your consent during the advice process to gather this data and explain what information we require as well as why we need it. Sensitive personal information will always be processed and stored securely, and you can withdraw your consent at any time. However, it is possible that you will no longer be able to access the service or product the information was gathered for if you choose to do so.

When a company processes special category information they must have “legal basis” to use it, which means a legal reason from GDPR. The legal basis we rely on is “legal obligation” – meaning we must process your data because the law or regulations require us to do so.

Companies must also meet one of the legal conditions in Article 9 of the GDPR. Aggregated Data

We also collect and process aggregated data.

That’s information about our customers that we combine together so that it cannot be used to identify any specifical individual. We use this for all sorts of business reasons – like market analysis and research, demographic profiling, marketing and advertising, and to comply with regulation.

Aggregated data isn’t considered personal data because it won’t reveal your identity. But if we combine or connect aggregated data with your personal data so that it can identify you, we’ll treat that combined data as personal data, and it will be processed in accordance with our policies for person data.

Data Retention

We’ll only keep your data for as long we need it to carry out the service you’ve requested of us. Or where law and regulation tell us we need to keep it for a specific amount of time. Personal information will be securely disposed of when it is no longer required, in accordance with recommended data control and disposal practices. If you submit a mortgage application through us and your application is unsuccessful, we’ll keep your data for 6 years.

If you get a mortgage through us, we’ll keep your data for the term of the mortgage and for 6 years after that. This helps us talk to you about your mortgage in the future, and get you on the best deal when it’s time to remortgage. It also helps us make sure we gave you the most appropriate advice.

Sometimes we anonymise your personal data (so it can’t identify you anymore) for research or statistics. We keep that data for as long as we need it.

Do you need to talk to us about how long we keep your data, or ask us to delete your data? You can get in touch using the contact details at the end of this privacy policy. If we have to wait, or if we can’t delete your data, we’ll let you know the reasons why – this is often due to laws or regulations which stipulate that we have to wait a certain amount of time before we’re allowed to delete your data. 

How we collect information

We will collect and record your personal data from a variety of sources, but mainly directly from you.

You will usually provide information during the course of our initial meetings or conversations with you to establish your circumstances and needs and preferences in relation to mortgages/finance. You will provide information to us verbally and in writing, including email.

We may also obtain some information from third parties, for example, credit checks, information from your employer, and searches of information in the public domain such as the voters roll. If we use technology solutions to assist in the collection of your personal data, for example software that is able to verify your credit status, we will only do this if we have consent from you for us or a processing partner to access your information in this manner.

With regards to electronic ID checks we would not require your consent but will inform you of how such software operates and the purpose for which it is used.

Automatically collected data –

  • Our website automatically collects technical data. This can include information such as the device you’re using to access our website, the country you’re accessing from as well as a record of what pages you’re visiting. We use cookies for this, and we have further information about cookies further into this policy.

Data from other sources. Sometimes personal data is acquired from outside of Sail Mortgages, which can include – 

  • Analytics providers: These are services that help us understand how people use our website, for example Google Analytics and Optimizely. This data will be collected whenever you engage with our website.
  • Meta pixel: We may opt to install a Meta pixel on our website. This a commonly used piece of code which is installed on websites to measure and optimize audiences for ad campaigns. It is similar to an analytics tool, as it enables the measuring of the effectiveness of advertising by understanding the actions users take while on our website.
  • Credit reference agencies, i.e., Experian: These are the companies who hold your credit history and credit report. This is a requirement when you apply for a mortgage.
  • Public sources: Such as Companies House and the Electoral Register. We check these sources as a part of your mortgage application, this is done to verify what you’ve told us.

We claim no control over these websites and/or apps and are not responsible for their privacy policies. As such, they may collect and process data about you in a different way than we do. Sharing your data

There is only a few instances where will need to share your data.

In each case, your personal data will only be shared for the purposes of progressing your mortgage enquiry and to provide you with our professional services

Please note that sharing of your personal data does not entitle any third parties to send you marketing or promotional messages. We are only sharing such data to ensure we can adequately fulfil our responsibilities to you, and we do not provide them with any consents on your behalf to use this data further than this goal.

We will also share information with lenders and providers in order to provide the services detailed. These lenders and providers will each have their own Privacy Policies which can be found on their websites.

In endeavouring to provide our services to you we will not knowingly allow your personal data to be transferred outside of the European Economic Area. However, cannot speak for third party services, please see their Privacy Policies.

Outside of this, where required we will also share your data with regulatory bodies, the police and fraud prevention agencies, to prevent and detect fraud. As well as third parties where required by law, court order or regulation.

What happens to your personal data?

Your personal data may be recorded and stored in any / all of the following, our paper files, mobile devices and on our computer systems – including websites, email, hard drives, and cloud facilities. This information can only be accessed by employees and consultants within Sail Mortgages and only when it is necessary to provide our service to you and to perform any administration tasks associated with that purpose.

Submit personal data to mortgage lenders/commercial Lenders and/or insurance product providers, both in paper form and online via a secure portal. The provision of this information to a third party is essential in allowing us to progress any enquiry or application made on your behalf and to deal with any additional questions or administrative issues that lenders and providers may raise.

Use Your personal data for the purposes of responding to any queries you may have in relation to any mortgage product you may take out, or to inform you of any developments in relation to those products and/or polices of which we might become aware.

How we use your personal information?

We process your information in order to support and maintain our contractual relationship with you and to comply with legal and regulatory requirements. This includes the following:

  • Providing our advice, products or services to you
  • Carrying out transactions you have requested
  • Confirming and verifying your identity for security purposes
  • Credit scoring and assessment, and credit management (if applicable)
  • Detecting and preventing fraud, crime, money laundering or other malpractice

We also process your data for specific business purposes to enable us to provide you with the best products and services as well as the most secure experience. Our business purposes include the following:

In some circumstances we’ll immediately do this for example, if the data is being used for marketing. However, please be aware there are situations where we’re not able to, or where we will refuse to; in such cases will inform you thusly
  • The right not to be subject to automated decision-making (including profiling) – you can challenge any decision previously made by automated decision-making, and request for a human to review it.
  • The right to object – you may object to the processing of your data based on legitimate interests. Moreover, at any point you can withdraw your consent. If you’ve given us consent to use your data for a specific reason, you can withdraw this at any time.
  • The right to data portability – you may request to obtain and reuse your data.
  • The right to erasure – you may request the deletion or removal of personal data where there is no compelling reason for its continued processing. To ask us to delete your information, please contact us using the details at the end of this policy; once we’ve received your request, we’ll respond to it within one month. Sometimes we might have to keep your data, due to laws or regulations. If this is the case, we’ll give you these reasons why when we respond to you.
